Agreement
These Terms govern your access to Data Racing, including the website, game, accounts, leaderboards, wallet login, digital items, NFT-related features, and purchases. By creating an account, connecting a wallet, signing in, buying an item, or using the service, you agree to these Terms.
If you do not agree, do not use the service. We may ask you to accept these Terms during first registration, authorization, and online purchases.
Eligibility
You must be at least 18 years old, or the age of majority in your jurisdiction if higher, and legally able to enter a binding agreement. You may not use the service if you are barred under applicable law, sanctions rules, or platform rules.
You are responsible for making sure your use of the service, wallet, blockchain networks, and purchases is legal where you live.
Entertainment only
Data Racing is a game and creative technology product that combines open data, racing mechanics, and optional blockchain-based digital ownership. It is provided for entertainment, collection, expression, and gameplay.
Nothing in the service is financial, investment, legal, tax, trading, or professional advice. We do not recommend buying, selling, holding, trading, staking, or investing in any token, NFT, asset, currency, security, or commodity.
Race tracks may use historical or real-time market data, weather data, macro data, or blockchain data as terrain input. That data is game material. It is not a recommendation, forecast, signal, endorsement, or invitation to trade.
No gambling or wagering
The service is not designed as a casino, sportsbook, lottery, betting exchange, prediction market, or gambling product. Unless a separate legally reviewed feature is expressly launched in a permitted jurisdiction, you may not use Data Racing to wager, bet, or stake value on outcomes.
Leaderboard status, game scores, race results, collectibles, and cosmetic items are for entertainment and community participation. They should not be treated as a promise of winnings, profit, yield, or financial return.
Accounts, wallets, and signatures
A wallet (MetaMask or any EVM-compatible wallet you control) is the single entry point to Data Racing. Every account, every earned skin, and every score is rooted in the wallet you sign in with. You may later link additional identifiers — Farcaster, Telegram, email — to the same wallet account for convenience, but the wallet remains the source of truth.
You are responsible for your wallet, private keys, devices, accounts, signatures, transactions, and approvals. We cannot recover private keys, reverse blockchain transactions, or guarantee the behavior of wallet software, RPC providers, bridges, exchanges, or networks.
Only sign messages or transactions you understand. You are responsible for gas fees, network fees, taxes, and consequences of transactions you approve.
Purchases and digital items
We may sell access, race entries, cosmetic items, textures, bikes, or NFTs as digital goods for entertainment. Unless expressly stated, digital items do not give governance rights, equity, revenue share, dividends, royalties, profit rights, financial claims, or ownership of Data Racing intellectual property.
Prices may change. Availability may change. Digital items may depend on software, networks, contracts, marketplaces, or metadata systems that can change or fail. To the maximum extent permitted by law, purchases are final once a blockchain transaction is submitted to the network, regardless of whether the product is later delivered. Your statutory consumer rights are not limited by this section.
If an item includes an NFT, ownership of the token does not automatically include copyright, trademark, or commercial rights in artwork, brands, code, game systems, or Data Racing content unless we expressly grant those rights in writing.
Your choice, your timing. Every purchase is your decision. You pick the item, the currency, the chain, and the moment to sign. We do not contact you to upsell, time-pressure, or recommend purchases, and the service contains no automated triggers that send funds without your wallet signature.
Quote and price-lock window. When you start a purchase we quote an amount in your selected currency and lock that amount for fifteen minutes. The quoted amount is exactly what your wallet will transfer. If you do not sign within the window, the quote expires and you must re-quote at the then-current rate. We do not retroactively re-price after you sign.
Volatility risk. Cryptocurrency exchange rates move outside our control. You bear the risk of any rate change between the moment you accept a quote and the moment your transaction confirms on chain. We do not adjust, top up, or compensate for market movement, and we are not your broker, exchange, or hedging counterparty.
Sanctions and AML screening. To comply with sanctions and anti-money-laundering law, payments are screened and transactions from wallet addresses identified on sanctions lists are automatically blocked and cannot be completed. We may also decline or hold a purchase from a wallet our screening flags as high-risk. If you believe a block is mistaken, contact support.
Right chain, right token, right amount. Each on-chain payment must use the exact chain, token, and amount we quote. Payments that do not match all three, or that arrive without a preceding order created through the in-game checkout, are transactions we cannot match automatically; such payments may be retained without product delivery and may not be recoverable. The interface warns you before signing whenever the wallet amount does not match the quote.
No custody, no chargeback. Our gateway contract forwards your payment directly to the treasury wallet within the same transaction you sign — we never custody, hold, or pool user funds. On-chain transactions are final once submitted to the network and cannot be charged back, reversed, refunded, or unwound by us, your wallet, the blockchain, any exchange, or any payment processor. Gas and network fees are your responsibility, including on failed, reverted, expired, or wallet-rejected transactions.
If our own system fails to deliver a digital item that you correctly paid for — same chain, same token, exact amount, identifiable order — write to support@datarace.club with your wallet address and transaction hash. We will investigate and resolve at our reasonable discretion, typically by delivering the item, granting an equivalent item, or, where neither is possible, returning the value to the same wallet. This commitment applies only to genuine delivery failures on our side and does not create a refund right for buyer's remorse, market movement, mismatched payments, or third-party wallet, RPC, or network errors.
Account deletion
You can permanently delete your account at any time from Settings → Danger zone. Deletion is irreversible and immediate. To confirm, you must sign a message with the wallet linked to your account — a stolen session cookie alone cannot delete you.
When you delete, we erase your profile, sessions, settings, gameplay history, equipped items, and pending unclaimed rewards. Tracks you authored are hidden from the catalogue; other players' results on them are preserved. You are removed from the referral tree, and people you invited are re-parented to your inviter.
NFTs you own remain on your wallet — we do not transfer or burn them. The next time you sign in with the same wallet, the items reappear in your garage automatically. On-chain transactions, including payments to our gateway contract, remain on the blockchain forever; we cannot delete blockchain history. Payment records in our database are anonymized (not deleted) where required for accounting, tax, anti-fraud, or legal-claim defense.
A minimal audit record of the deletion itself (your account UUID, wallet address, timestamp, hashed IP) is retained to defend against later disputes and meet legal obligations. You may create a new account with the same wallet later; we do not offer a restore pathway for the deleted profile.
User conduct
You may not cheat, exploit bugs, manipulate race submissions, attack infrastructure, bypass rate limits, abuse referrals, scrape at unreasonable scale, infringe intellectual property, harass others, impersonate people, launder funds, evade sanctions, or use the service for unlawful activity.
We may suspend accounts, remove leaderboard entries, block transactions, restrict access, or report abuse if we reasonably believe these Terms, game rules, law, or security are being violated.
User content
If you upload or submit usernames, avatars, profiles, messages, race names, or other content, you grant us a worldwide, non-exclusive, royalty-free license to host, display, reproduce, adapt, and use that content only as needed to operate, promote, secure, and improve the service.
You represent that you have the rights needed to submit your content and that it does not violate law or third-party rights.
Service changes and availability
Data Racing is experimental and may change. We may add, remove, pause, or modify features, tracks, items, pricing, networks, rules, leaderboards, and availability. We may run pre-launch, beta, or test versions that contain bugs or downtime.
We do not guarantee uninterrupted access, permanent availability of every item or feature, or compatibility with every wallet, device, chain, marketplace, or browser.
Disclaimers and liability
The service is provided as is and as available. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, accuracy of data feeds, market-data availability, blockchain availability, and error-free gameplay.
To the maximum extent permitted by law, we are not liable for lost profits, lost value, lost tokens, failed transactions, gas fees, market movements, wallet compromise, third-party services, indirect damages, or consequential damages. Nothing in these Terms limits liability that cannot legally be limited.
Changes, termination, and law
We may update these Terms as the product, law, or risk profile changes. Material updates may require acceptance before continued account use or purchases.
You may stop using the service at any time. We may suspend or terminate access if needed for security, legal compliance, abuse prevention, or violations of these Terms. The sections on purchases, digital items, intellectual property, disclaimers, liability, and disputes survive termination.
These Terms are intended to be enforced to the maximum extent allowed by applicable law while preserving mandatory consumer protections in your jurisdiction.
